JOBTABLE MESSAGING TERMS
These Messaging Terms (“Messaging Terms”) govern your use of the SMS messaging feature (“Messaging Feature”) available as an add-on to the Jobtable Platform. These Messaging Terms are incorporated into and form part of the Jobtable Subscriber Terms and are subject to all provisions of the Jobtable User Terms and Privacy Policy. Capitalized terms not defined here have the meanings set forth in those agreements.
By activating the Messaging Feature, you (“Subscriber”) agree to be bound by these Messaging Terms.
1. Description of the Messaging Feature
The Messaging Feature allows Subscribers to send transactional and operational SMS messages to their customers and contacts (“End Recipients”) in connection with their field service business. Permitted use cases include, but are not limited to: appointment reminders, job status updates, dispatch notifications, invoice delivery, and customer follow-ups.
The Messaging Feature is powered by Twilio Inc. (“Twilio”), a third-party messaging provider. By using the Messaging Feature, you acknowledge that your use is also subject to Twilio’s applicable terms of service and acceptable use policies.
The Messaging Feature is not intended for and may not be used for unsolicited commercial advertising, promotional campaigns, or bulk marketing messages.
2. Subscriber Obligations — All Users
By activating the Messaging Feature, Subscriber represents, warrants, and agrees to the following:
a) Consent Subscriber has obtained, or will obtain prior to sending any message, the necessary consent from each End Recipient to receive SMS messages. Subscriber is solely responsible for obtaining, documenting, and maintaining records of such consent.
b) Opt-Out Subscriber must honor all opt-out requests immediately. Subscriber must ensure that End Recipients can reply STOP to any message to unsubscribe, and that any such request is actioned without delay. Subscriber must not send further messages to any End Recipient who has opted out.
c) HELP Response Subscriber must ensure that End Recipients who reply HELP receive a response that includes the Subscriber’s business name, a description of the messaging program, and contact information.
d) Required Disclosures Where required, Subscriber must disclose to End Recipients prior to or at the point of consent collection: (i) that message and data rates may apply; (ii) the approximate message frequency; and (iii) how to opt out.
e) Prohibited Content Subscriber must not use the Messaging Feature to send content that is: sexually explicit; related to hate speech or discrimination; related to illegal substances, firearms, tobacco, or cannabis (where restricted); related to high-risk financial products; or otherwise in violation of applicable law or carrier guidelines (collectively, “Prohibited Content”).
f) No Sale or Sharing of Numbers Subscriber must not sell, rent, transfer, or share any End Recipient phone numbers collected through or in connection with the Messaging Feature with any third party for marketing purposes.
g) Accurate Identification All messages must accurately identify Subscriber as the sender. Messages must not be misleading or deceptive as to their origin or purpose.
3. US Users — Additional Requirements
If Subscriber is located in the United States or sends messages to End Recipients with US phone numbers, the following additional requirements apply:
a) TCPA Compliance Subscriber must comply with the Telephone Consumer Protection Act (TCPA), FCC regulations, and CTIA guidelines, as each may be amended from time to time. Subscriber is solely responsible for ensuring its use of the Messaging Feature complies with all applicable US federal and state messaging laws.
b) 10DLC Registration SMS messages sent to US recipients via the Messaging Feature are transmitted through Jobtable’s registered A2P 10DLC campaign with The Campaign Registry (TCR). Subscriber acknowledges that use of the Messaging Feature is subject to carrier and TCR rules governing registered campaigns, and that Jobtable may suspend or terminate Subscriber’s access to the Messaging Feature if Subscriber’s usage violates those rules or causes the campaign registration to be at risk.
c) Prior Express Written Consent For marketing or promotional content (where permitted), Subscriber must obtain prior express written consent as defined under the TCPA before sending any such message.
4. Canadian Users — Additional Requirements
If Subscriber is located in Canada or sends messages to End Recipients with Canadian phone numbers, the following additional requirements apply:
a) CASL Compliance Subscriber must comply with Canada’s Anti-Spam Legislation (CASL) and any regulations made under it, including the requirements administered by the Canadian Radio-television and Telecommunications Commission (CRTC). Subscriber is solely responsible for ensuring its use of the Messaging Feature complies with CASL and all other applicable Canadian messaging laws.
b) Express Consent Under CASL, express consent is required before sending commercial electronic messages, including SMS. Subscriber must not rely on implied consent unless Subscriber has verified that an existing business relationship meets the requirements and time limitations permitted under CASL.
c) Identification and Unsubscribe Mechanism Each message sent to a Canadian End Recipient must clearly identify Subscriber and include a functional unsubscribe mechanism in compliance with CASL requirements.
d) Quebec Subscribers with End Recipients in Quebec should be aware of applicable language requirements under the Charter of the French Language (Bill 96). Subscriber is responsible for ensuring compliance with any applicable Quebec-specific requirements.
5. Jobtable’s Role and Limitation of Liability
Jobtable provides the Messaging Feature as a technology platform only. Jobtable is not the sender of any SMS messages transmitted by Subscriber and is not responsible for the content, timing, consent status, or regulatory compliance of any messages sent by Subscriber through the Messaging Feature.
Subscriber agrees to indemnify and hold harmless Jobtable, its officers, directors, employees, and agents from and against any claims, damages, fines, penalties, or expenses (including reasonable legal fees) arising out of or relating to Subscriber’s use of the Messaging Feature, including any violation of applicable law, carrier rules, or these Messaging Terms.
Jobtable reserves the right to suspend or terminate Subscriber’s access to the Messaging Feature at any time, without notice, if Jobtable reasonably believes that Subscriber’s use violates these Messaging Terms, applicable law, or Twilio’s acceptable use policies, or if continued access would expose Jobtable to regulatory, legal, or reputational risk.
6. Relationship to Other Jobtable Agreements
These Messaging Terms supplement and are incorporated into the Jobtable Subscriber Terms. In the event of a conflict between these Messaging Terms and the Subscriber Terms with respect to use of the Messaging Feature, these Messaging Terms shall control. These Messaging Terms are subject to the choice of law, dispute resolution, and limitation of liability provisions set forth in the Jobtable User Terms.
7. Amendments
Jobtable may amend these Messaging Terms from time to time. Where required by applicable law or carrier policy, Jobtable may update these terms without prior notice. Continued use of the Messaging Feature following any amendment constitutes acceptance of the revised terms.
